Here's what protecting WB Governor from legal action against sexual harassment

A contractual staffer at Kolkata's Raj Bhavan has lodged a complaint against West Bengal Governor CV Ananda Bose, alleging sexual harassment. The complaint was registered at the Hare Street police station in Kolkata. Governor Bose refuted the allegations, dismissing them as politically motivated. 

However, Bose, holding a constitutional post, is shielded from criminal charges while in office due to the immunity granted by the Indian Constitution.

The Governor of a state holds a constitutional post, appointed by the President through a warrant under their hand and seal, serving at the President's pleasure. Constitutional provisions, particularly Article 361, grant certain immunities to the President and governors, including protection from legal accountability during their term.

According to Article 361 of the Indian Constitution the President and Governors have certain immunities as mentioned below: 

• They cannot be held accountable in court for their actions or decisions while in office “for the exercise and performance of the powers and duties of his office or for any act done or purporting to be done by him in the exercise and performance of those powers and duties.”
• No criminal charges can be filed against them "in any court" during their tenure.
• They are immuned against arrest or imprisonment during their term
• Civil proceedings against them for personal actions, whether before or after he entered his office, can only be initiated after a two-month notice, specifying the nature of the proceedings and relief sought.
